Website Terms of Use
Effective Date: October 2, 2026
These Website Terms of Use ("Terms") govern your access to and use of the Tote Outfitter Rentals website at toteoutfitter.com, online booking pages, and related online services (collectively, the "Website"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1 About Tote Outfitter Rentals
Tote Outfitter LLC, doing business as Tote Outfitter Rentals ("Company," "we," "us," or "our") provides reusable moving tote and related equipment rental services, including delivery and retrieval, within its designated service area. Information on the Website helps customers learn about available rental packages, request or make reservations, review policies, and communicate with the Company.
2 Eligibility and Authority
You may use the Website only if you are legally able to enter into binding agreements. If you use the Website on behalf of a business, organization, household, or another person, you represent that you are authorized to act on that party’s behalf.
3 Online Reservations
Submitting a reservation through the Website does not guarantee availability until the reservation is accepted and confirmed by Tote Outfitter LLC. Rental dates, package availability, delivery eligibility, pricing, taxes, delivery charges, and other order details are subject to the information shown during checkout and the confirmed reservation.
The full initial reservation amount is due at booking. Customers must review and sign the Rental Agreement and applicable related acknowledgments before delivery. We will contact customers to arrange delivery and retrieval windows.
Rental transactions are also governed by the Tote Outfitter Rentals Rental Agreement and applicable policies, including the Damage, Loss & Cleaning Policy, Payment Method and Additional Charge Authorization, Cancellation and Rescheduling Policy, and Porch Delivery & Retrieval Policy and authorization when applicable. The Privacy Policy describes how personal information is handled. These rental documents must be made available for review before payment.
4 Accuracy of Customer Information
You agree to provide accurate, current, and complete information when using the Website or making a reservation. This includes your name, contact information, billing information, delivery and retrieval addresses, access instructions, and any other information reasonably required to complete your rental.
You are responsible for reviewing your reservation before submitting it and for promptly notifying us if important information changes.
5 Pricing Taxes and Delivery Charges
Prices, rental durations, package contents, taxes, and delivery charges are displayed during the booking process and may change prospectively. The price applicable to a confirmed reservation is the price shown in that reservation, subject to approved changes, extensions, additional charges, refunds, or corrections permitted by the Rental Agreement and related policies.
Delivery availability and delivery charges may be based on distance, service area, address eligibility, or other operational factors. Any service requiring a separate quote must be approved by the Company before it is confirmed.
6 Payments
Card payments made through the Website are processed through Booqable using Stripe. By submitting payment information, you represent that you are authorized to use the payment method and authorize the applicable initial charges associated with your reservation.
Where you separately authorize a payment method to be saved for later use, subsequent charges must be consistent with the Payment Method and Additional Charge Authorization and the other agreements applicable to your rental. Initial payment alone does not replace that separate authorization. Card-saving availability depends on the payment method and the supported booking and payment settings.
7 Acceptable Use
You agree not to use the Website to:
- Submit false, misleading, fraudulent, or unauthorized reservations or payment information.
- Interfere with, disable, damage, overload, or disrupt the Website or related systems.
- Attempt to gain unauthorized access to accounts, payment systems, administrative areas, data, or networks.
- Use automated tools to scrape, copy, harvest, or misuse Website content or customer information without permission.
- Introduce malicious code, viruses, harmful files, or other technology intended to disrupt or compromise the Website.
- Impersonate another person or misrepresent your identity, authority, or affiliation.
- Use the Website for unlawful, abusive, threatening, or fraudulent purposes.
8 Intellectual Property
The Website and its original content, including business names, logos, graphics, photographs, package descriptions, written materials, page layouts, and other content created for Tote Outfitter LLC, are owned by or licensed to Tote Outfitter LLC and are protected by applicable intellectual property laws.
You may view and use Website content to evaluate or purchase our services for yourself or a party you are authorized to represent. You may not reproduce, republish, distribute, sell, modify, or commercially exploit Website content without prior written permission, except as permitted by law.
9 Third Party Platforms and Links
The Website uses or may link to third-party services, including Booqable for reservations, Stripe for payments, and other mapping, hosting, analytics, or communications providers. Those services may be governed by their own terms and privacy policies. Tote Outfitter LLC does not control independent third-party websites or services and is not responsible for their content, availability, or practices except to the extent required by applicable law.
10 Website Availability and Changes
We may update, modify, suspend, or discontinue Website features from time to time. We do not guarantee that the Website will always be uninterrupted, error-free, or available at every time or from every device.
We may correct typographical, pricing, availability, or technical errors when discovered. If a material error affects a submitted reservation, we will contact the customer and provide an appropriate correction, alternative, or refund as reasonably applicable.
11 Informational Content
General moving tips, package suggestions, capacity estimates, or other informational content on the Website are provided for convenience only. Actual packing needs vary by household, property, belongings, and moving circumstances. Customers are responsible for selecting the package and equipment appropriate for their particular needs.
12 Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Website is provided on an "as is" and "as available" basis. We do not warrant that Website content will always be complete, current, error-free, or suitable for every purpose.
Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded or limited.
13 Limitation of Liability
To the fullest extent permitted by applicable law, Tote Outfitter LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of or inability to use the Website.
These Website Terms do not replace or expand any liability provisions contained in the Rental Agreement, and nothing in these Terms limits liability where limitation is prohibited by applicable law.
14 Indemnity for Misuse
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful or unauthorized misuse of the Website, your fraudulent activity, or your material violation of these Terms.
15 Privacy
Your use of the Website is also subject to the Tote Outfitter Rentals Privacy Policy, which describes how personal information may be collected, used, shared, retained, and protected.
16 Electronic Communications
By using the Website or submitting a reservation, you consent to receive electronic communications related to your inquiry or transaction, such as confirmations, receipts, delivery or retrieval notices, policy notices, and service messages. Marketing communications, when used, will be handled in accordance with applicable law.
17 Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles, except where another law must apply. Any dispute concerning a rental transaction may also be governed by the dispute or venue provisions, if any, in the applicable Rental Agreement.
18 Changes to These Terms
We may update these Terms from time to time. The version posted on the Website will state its effective date. Changes apply prospectively unless otherwise required by law. Terms governing an already-confirmed rental will not be changed retroactively in a way that materially reduces the customer’s agreed rights unless legally permitted and properly communicated.
19 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
20 No Waiver
If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
21 Contact
Questions about these Terms may be submitted using the contact information published on toteoutfitter.com or by replying to the booking confirmation email associated with your reservation.
22 Relationship to Rental Agreements
These Terms govern use of the Website. A customer’s actual rental is governed by the confirmed reservation, Rental Agreement, and incorporated rental policies. If these Website Terms conflict with a specific term of the Rental Agreement concerning a rental transaction, the Rental Agreement will control for that transaction.
